These Insurers often find themselves in complex claim situations that involve collateral carriers and government bodies and their respective regulations and internal policies. We realize the work that is involved in understanding and effectively dealing with these various legislative acts and policies such as The WSIB Act and Group Benefit/Private Disability Insurance Carriers. We also realize that many examiners lack the experience and/or time to fully understand and deal effectively with these issues.
To respond to these concerns, we have developed a Specialized WSIB & Collateral Response Group headed by G. Anthony Magagna. He brings with him extensive experience as a former WSIB Adjudicator and a Corporate Health and Safety Consultant as well as All Lines Licensed Adjusting. The focus of this team is to ensure that all opportunities to reduce or eliminate injury exposures are explored by maximizing all available benefits offered through Collateral Carriers and the WSIB (including other provincial WCBs). This Group capitalizes on expertise in both all lines adjusting and extensive training and experience in the WSIB and Collateral benefit field. You the Insurer benefits from reduced or eliminated exposures.
Our ongoing relationship with the WSIB and Group Insurance Carriers allows us access to key personnel and internal policy details, which can make those complex collateral and WSIB claims easier to manage and resolve. Our fastest growing service within our Response Group is forcing eligible claims to the WSIB and Section 31 (WSIB Act) Appeals Tribunal; including independent operator issues.
OUR SERVICES
We will provide an opinion on the feasibility and eligibility of SABS, Auto Tort and Commercial claims being transferred to the WSIB utilizing our 50 point checklist and specialized statement system
We will initiate, complete and forward the necessary WSIB assignments, authorizations and pursue an approval and establishment of a WSIB claim (and other Provincial WCB Acts)
Whenever requested or required we will pursue with our Legal Contacts, any Section 31 appeals and claim decision reversals
When requested we will provide an opinion on owner/operator (independent operator) issues, and we will engage the WSIB on behalf of the Insurer to resolve claims based on the Insurer’s overall exposure costs
Our skilled staff will handle or assist you in establishing worker coverages where employers are in non-compliance with the WSIB Act, whether they be Schedule 1 or 2 employers
We utilize recent General Court and Arbitration decisions regarding independent operator and priority of coverage concerns to reduce the exposure of the SABS Insurer
